Participant Agreement

Below you can find the participant agreement, which details all that we are offering and expecting, and all of your rights and responsibilities in signing up for our Basic Training.  Please feel free to reach out with questions.

Participant Agreement

This participant agreement is between the participant, hereafter “participant”, and Empowered EMDR Solutions LLC, hereafter “Empowered EMDR Solutions” or “trainer”. This agreement relates to participation in EMDR Basic Training, hereafter “training”. 

 

Eligibility: In accordance with EMDRIA’s requirements, the participant must meet eligibility criteria or fall into one of the “qualifying exemptions” categories in order to participate in the training. If the participant registers and does not meet these requirements, the participant will be removed and a $100 administration fee will be deducted from participant's refund. The trainer retains the right to accept, reject, and determine eligibility for any participant.

  • Licensure and Education: The participant must be licensed through the participant's state board in one of the following fields: Licensed Clinical Social Worker, Licensed Professional Counselor, Licensed Marriage and Family Therapist, Licensed Psychologist, Licensed Psychiatrist or Licensed Psychiatric Nurse.  If the participant resides outside of the United States, the participant is responsible for checking with their local EMDRIA organization regarding reciprocity with EMDRIA in the United States to assure that the participant qualifies to attend training. The participant must hold a Master’s degree in a mental health discipline.

  • Qualifying Exemptions (must obtain approval from trainer prior to registering): 

    • Pre-Licensed Mental Clinicians who are actively pursuing a mental health license through their state board while working under a licensed supervisor.  Qualifying Pre-Licensed Mental Health Clinicians must have a Master’s Degree in a mental health discipline.

    • Graduate Students enrolled in a Master’s or Doctoral program in a mental health discipline. Students must have completed their core graduate academic coursework and must be in the practicum/internship portion of their graduate program. Graduate students will be asked to submit a transcript, practicum or internship details, and a letter from a fully licensed supervisor, which includes the supervisor’s license information and number. 

    • May qualify, but will need to inquire with EMDRIA about an exception prior to registration: State Certified Counselors, Degree/License in School Counseling, Art Therapy, Music Therapy, Christian/Pastoral/Community Counseling, Drug/Alcohol Counseling, Forensic Psychology.

Cancellation and Refund Policy

  • Cancellations must be requested in writing by the participant and will be confirmed in writing by the trainer.

  • Refunds (minus a $100 administration fee) will be given for cancellation requests made more than 30 days before the beginning of the scheduled event. 

  • No refunds will be given for cancellations 30 days from the training or less.  However, the participant may transfer registration to different scheduled dates within one year of the original training, after paying a $100 administration fee.   

  • Once a training has started, no transfers will be able to be made unless a verified emergency has taken place.  The trainer may allow the training dates to be made up, at the sole discretion of the trainer and if there is availability.  Be aware of the potential that make-up training times may not be approved by the CE program.

  • If the participant does not attend the training and does not obtain verification of an emergency from the trainer, there will be no make-ups, refunds or transfers allowed.

  • If the participant misses more than 15 minutes of any training day, the EMDRIA requirements for the training are no longer met.  At the discretion of the trainer, the participant may make-up the missed time at the trainer’s consultation rate of $100/hr, for one hour minimum. 

  •  No partial credit will be given if any portion of the training is missed and not made up, resulting in the inability for the participant to attain a certificate of completion or CEs.

  • The trainer will not be held responsible for damages or expenses incurred as a result of the participant’s cancellation or failure to attend.

  • The trainer reserves the right to cancel the training at any time and for any reason.  If the trainer cancels the training, the participant will be notified and issued a full refund or a free transfer to attend a different training. The trainer will not be held liable for expenses incurred by the participant due to the trainer's cancellation.

  • The participant's place in the training and registration fee are not transferable.

Code of Conduct

The participant agrees to abide by the following code of conduct:

  • To conduct oneself in a professional and ethical manner as defined by participant’s licensing board and EMDRIA’s codes of ethics

  • To refrain from engaging in other modalities during the practice portion of the training

  • To refrain from disrupting the training

  • To refrain from soliciting other participants in the training

  • To refrain from recording any portion of the training

  • To maintain confidentiality regarding trainer and other participant’s confidential information

  • To contribute to the supportive environment the trainer strives to create

The trainer reserves the right to request that any participant leave the training immediately if the participant violates the above code of conduct, as determined at the discretion of the trainer. If the participant is asked to leave, the participant's registration will be canceled and the participant will not receive a credit or refund.

Further Participant Expectations

  • The participant acknowledges that the following is required by the trainer:

    • Attend a scheduled 30 minute pre-training meeting

    • Read the required reading materials:

      • Go With That Magazine Fall 2020, Volume 25, Issue 3 [EMDR & Racial Trauma] 

      • Guidelines for Virtual EMDR Therapy (Spring 2020)

    • Participate and engage in the practicum at a level expected of a professional

    • Attend all training days, missing no more than 15 minutes, per EMDRIA’s requirements

    • Schedule and complete 10 hours of consultation

    • Complete all training requirements within one year (12 months) of the first training day

  • Participants will be provided either a printed or PDF version of the course manual and training materials. The participant agrees to not share or distribute the training material without written consent from Empowered EMDR Solutions.  Online participants may want to print materials prior to the training.

  •  The participant acknowledges that the practicum portion of the training is required, which will include practice in the roles of “clinician”, “client”, and “observer.”  The participant acknowledges that this learning environment is not a therapeutic environment, and therefore neither the trainer or other therapists are responsible for the participant’s emotional well-being.  

Informed Consent

The trainer will coordinate all scheduling, registration, provision of materials, evaluation, and provision of certificates through the trainer’s learning management system, for which the link is shared on all promotional material.

Confidentiality is an important part of the training’s code of conduct; however, the trainer cannot guarantee the behavior of participants, and therefore cannot guarantee the confidentiality of any information disclosed by a participant. The participant agrees to hold the trainer harmless and agrees that the trainer is not liable for claims regarding personal information that the participant disclosed during the training.

The participant acknowledges that lecture portions of the training, including demonstrations, may be recorded and used for training purposes by Empowered EMDR Solutions, potentially being published as teaching material on the learning management system or other websites.  The participant acknowledges that any information revealed by the participant during the lecture portion of the training, or volunteered during a demonstration, will not be considered confidential. 

The participant acknowledges that the boundaries of clinical applications for EMDR have not yet been confirmed by controlled research. Many of EMDR’s clinical applications are based primarily on anecdotal reports by clinicians.  

The participant understands that participating in the practicing of EMDR skills during the training may lead to continued reprocessing outside of the training, including (but not limited to) heightened emotions, dreams, nervous system activation, flashbacks, and dissociation.  The participant agrees that the participant alone is responsible for self-care and to have pre-arranged supports in place if needed.

If the participant is being treated through psychotherapy or psychiatric treatment, the participant agrees to inform the participant’s clinician/psychiatrist about the practicum component of this training, securing permission to participate before beginning this training.

Participants diagnosed with a dissociative disorder, a personality disorder, PTSD or a panic disorder, substance use disorder, or affective disorder acknowledge that special arrangements must be made with the trainer prior to registration. The participant acknowledges that failure to do so may result in dismissal from the training without refund.

Participants with limiting or special medical conditions (including but not limited to traumatic brain injury or seizure disorder, heart condition, and ocular difficulties) agree to consult a medical professional, securing permission to participate before beginning this training.

The trainer does not discriminate on the basis of disability. In accordance with ADA requirements, if the participant needs supportive aids and services for effective communication, or a reasonable modification in the training, the participant should contact the trainer as soon as possible, preferably 30 days before the training. 

The participant acknowledges the risks inherent in participating in the training, including but not limited to trips or falls on the premises of the training. 

The participant agrees that attendance and participation in the activities of the training is completely voluntary, and that the participant has considered the risks involved. The participant agrees to take full responsibility for these assumed risks.

 

Grievance Policy 

While Empowered EMDR Solutions works toward fair treatment and will attempt to repair any problems, issues may arise which require intervention. The following is Empowered EMDR Solutions’ procedure for handling grievances.

  • Grievances must be submitted in writing with any supporting documentation through: 

    • the Learning Management System’s grievance link

    • the postal mail to: Empowered EMDR Solutions, 9066 Perry Highway Ste. 4, Pittsburgh PA 15237.

  • Empowered EMDR Solutions will work to adequately resolve properly filed grievances.  However, the trainer cannot guarantee a specific action or result.

 

Liability, Arbitration, Severability, Scope of Agreement

 

The participant and trainer agree that arbitration will be the only means of initiating adversarial proceedings to resolve a dispute. The participant or the trainer may ask that any dispute be resolved by arbitration by the American Arbitration Association in accordance with its commercial arbitration rules. Each party consents to any such dispute being so resolved. Each party agrees that the laws of the state of Pennsylvania govern all adversarial proceedings arising out of this agreement.

 

The participant and trainer agree that if any provision of this agreement is legally unenforceable, then that provision will be modified to the minimum extent necessary to make it enforceable. However, even if an unenforceable provision is modified, the rest of the agreement will remain in effect as written. The participant agrees that this agreement supersedes all other agreements, whether written or oral, between the participant and the trainer.

 

By signing this agreement, the participant accepts all of the terms, conditions and requirements herein.  This includes a voluntary waiver, release and discharge of any and all liability; claims; actions or rights of action; or for any incidental, consequential, punitive or indirect damages related to, or arising from, or in any way connected with participant's participation in the training, consultations, or any other trainer sponsored programs. 

 

The participant acknowledges and accepts that this agreement is binding, and that the participant has read and agrees to this agreement.
